moriahcgibbs 6
I am currently trying to start a website for users to post artwork, videos, blog and such. However I am concerned about copyright laws. I know that in the past people have run into some pretty bad leagal issues because of copyright laws and i want to do everything i can to avoid a situation like that but still be able to have a successful website. If anyone can help me get some basic answers I would very much apriciate it: Am i responsible if one of my users posts and image without the owners consent? During user registration are there certain conditions that i could require to protect me legally if one of my users violates copyright laws? Is there any website that i can go to that puts this in perspective that i can understand without all the confusing legal terms?
Ingolme 1,035
If users post content on your site, you are required to remove anything that violates copyright as soon as the original author requests it. If you do that, there shouldn't be any legal problems for you as long as you do that. Responsibility falls upon the user (you should state it clearly in your terms of service)

soofi 0
I am currently trying to start a website for users to post artwork, videos, blog and such. However I am concerned about copyright laws. I know that in the past people have run into some pretty bad leagal issues because of copyright laws and i want to do everything i can to avoid a situation like that but still be able to have a successful website. If anyone can help me get some basic answers I would very much apriciate it: Am i responsible if one of my users posts and image without the owners consent? During user registration are there certain conditions that i could require to protect me legally if one of my users violates copyright laws? Is there any website that i can go to that puts this in perspective that i can understand without all the confusing legal terms? here are the answers to your questions Am i responsible if one of my users posts and image without the owners consent? Yes you are very much responsible for this as the content will be lying on your web-servers, which you are required to remove when you recieve notification about it from the original owner or anyone else for that matter. During user registration are there certain conditions that i could require to protect me legally if one of my users violates copyright laws? Yes you can put terms & conditions or terms of use in words for users to read and accept that they will be solely responsible for their actions on the site. Plus they (registered users) will not indulge in uploading copyrighted material on the site. if they do, you will be forced to remove the material in question right away (and without any notice). Is there any website that i can go to that puts this in perspective that i can understand without all the confusing legal terms? yes, you can visit youtube.com and check out these two links for best available information: www.youtube.com/t/terms & www.youtube.com/t/copyright_center If you are looking for information related to images only, you can goto flickr.com and check out this section: www.info.yahoo.com/legal/us/yahoo/copyright/en-us/ Let me know if you need more help. I'm going to be in need of similar checks once I am done with working on www.partyImages.com Edited October 24, 2012 by soofi

eurohttp 0
You should let users to upload copyright permissions. You should add option to choose copyright permission when someone uploads an image etc. And you should create Terms of Service to not be responisble for any stealing it may occur. Hope this helps. Beyonder 0
Some are required but on deviantart if the art is over 175+ days old copyright is invalid and if its found in the public domain no copyright is broken.
Ingolme 1,035
Some are required but on deviantart if the art is over 175+ days old copyright is invalid and if its found in the public domain no copyright is broken. This is incorrect. DeviantART's policies follow the USA copyright law. "Found on Google Images" or "found on deviantART" does not mean public domain. Artwork is considered public domain after 75 years following the death of the author, it is 50 years in some countries. Yes, that's a long time. I have plenty of artwork on deviantART that's over 175 days old and I have no plans of revoking my rights over it.
