This is an HTML comment. It's valid by default. Besides, if SSIs are enabled, the resulting page is what is going to be validated by the validator.

Yes, because remember, a SSI is written to the document before it is loaded in a viewer's browser, so similarly the W3C validator will also see the code included by the server, not the SSI tag. But remember, whatever you put inside comment tags <!-- --> doesn't matter, because it is excluded when parsing. So even if I typed <!-- dfasdfsdfasdffgeryserhg --> it would still be valid :)
